Parenting Dispute Mediation

Parenting Dispute Resolution (also known as Family Mediation) is a special type of family mediation which helps separated families come to their own agreements in relation to their children and parenting arrangements.

Compulsory

Except in limited circumstances, it is compulsory under Australian family law for separated parents to attempt Family Dispute Resolution before applying to a family court for parenting orders.

Benefits to the Family

Family Dispute Resolution allows parents to retain control of decision making for their children. After all, parents know their children and family better than the Courts. Agreements can be made swiftly and cost-effectively.

Parenting Plans and Consent Orders

The agreement you and your ex-partner reach Family Dispute Resolution is documented in a Parenting Plan. It can include for example:

  • How the child/children spend time with each parent
  • The day to day responsibilities of each parent for the child/children
  • How the parents will communicate and consult each other on long-term decisions for the children.

A parenting plan is a good faith agreement and not legally binding. If both parents want to make the parenting plan legally binding, you can draft and file Consent Orders without the need for a Court hearing. Once approved, Consent Orders have the same legal effect as if they had been made by a Judge.

Child Inclusive

Where appropriate, children can be included in the mediation process. The child is supported by a specialist child consultant.

For some children, the opportunity for them to discuss their thoughts and feelings in a safe and supported environment can be very helpful. Usually, the meeting between the child consultant and the child occurs on the same day as the mediation.

The child consultant then shares the information with the parents so that it can assist the parents with their decision making in mediation.

Certificates

If parties are unable to come to an agreement in Family Dispute Resolution, our Family Dispute Resolution Practitioner will issue a Section 60I Certificate which will enable the parties to commence proceedings in Court.
